Portugal’s Constitutional Court Confirms Golden Visa Family Reunification Benefits

August 13, 2025. Portugal’s Constitutional Court has upheld the preferential family reunification framework available to Golden Visa investors while striking down broader immigration restrictions contained in proposed amendments to the country’s Foreigners’ Law.

The ruling affirms that Portugal may continue to provide enhanced immigration benefits to investors and other strategic categories of residents, provided such measures pursue a legitimate public interest and remain consistent with constitutional principles.

Following the decision, President Marcelo Rebelo de Sousa vetoed the legislation and returned it to Parliament for reconsideration.

Court Protects Existing Golden Visa Framework

The proposed legislation would have introduced a two-year waiting period before most legal residents could apply for family reunification and would have narrowed eligibility primarily to spouses and minor children.

Golden Visa investors and certain highly qualified professionals were exempt from these proposed restrictions and would have retained broader family reunification rights.

The Constitutional Court ruled that while the state may differentiate between categories of legal residents, it cannot reduce fundamental constitutional protections relating to family life for the wider immigrant population.

As a result, the proposed restrictions cannot enter into force, and Portugal’s existing family reunification framework remains unchanged.

Implications for Golden Visa Investors

The decision provides important legal certainty for existing and prospective Golden Visa investors.

Under the current framework, qualifying investors continue to benefit from immediate access to family reunification provisions available under Portuguese immigration law, allowing eligible family members to obtain residence permits without the additional waiting periods proposed under the rejected legislation.

For investors evaluating long-term residency options, the ruling reinforces the stability of Portugal’s investment migration framework while confirming the government’s ability to maintain specific incentives designed to attract foreign investment.

Investment Migration Remains a Strategic Policy Tool

The Court recognised that the Portuguese legislature retains discretion to encourage foreign investment through differentiated immigration policies where supported by legitimate public policy objectives.

In its reasoning, the Court acknowledged that investment migration programmes may serve broader economic interests by attracting capital, supporting business activity, encouraging job creation, and contributing to economic development.

At the same time, the judgment establishes that any future immigration reforms must remain consistent with the constitutional protection of family unity and other fundamental rights.

What Happens Next?

The legislation will now return to Parliament, where the government is expected to revise the proposed reforms to address the Constitutional Court’s findings before introducing a new version of the law.

Until revised legislation is enacted, the existing immigration framework remains fully in force, including the current rules governing Portugal’s Golden Visa programme and family reunification rights.
