September 9, 2025. Malta is reshaping its citizenship policy following the European Court of Justice’s ruling that its previous Maltese Exceptional Investor Naturalisation (MEIN) programme was incompatible with EU law.
The government has confirmed that the former investment-based framework will be replaced by a Citizenship by Merit regime, removing the transactional elements identified by the Court while introducing a system based on an individual’s contribution to Malta’s national interest.
Home Affairs Minister Byron Camilleri has stated that the revised framework will broaden eligibility beyond financial investment, placing greater emphasis on innovation, entrepreneurship, philanthropy, job creation, culture, science, technology, and other forms of exceptional contribution.
From Investment to Merit
The European Court of Justice concluded that citizenship cannot be granted through predetermined financial contributions alone, finding that such arrangements effectively commercialised EU citizenship.
Malta’s response represents a fundamental shift away from a rules-based investment programme towards an individually assessed process. Rather than relying on fixed financial thresholds, applications will be evaluated on their overall contribution to Malta’s economic, social, scientific, cultural, or technological development.
The new framework is expected to include enhanced due diligence, independent assessment, consultation with relevant public authorities, and ministerial approval before any citizenship decision is made.
Greater Emphasis on Genuine Contribution
The proposed reforms indicate that applicants will be expected to demonstrate an established and meaningful connection with Malta together with evidence that their activities generate a measurable public benefit.
